I bet I saw it somewhere... Let me recall. It was a Talismat 2 theme ;) And author mentioned that he found a wallpaper on the net. Looking at it I don't see any refers to original creator and any copyright notes.
About theme itself: finding Gradient tool is not an excuse to complete lack of correspondence between wallpaper, toolbar and menu/taskbar. It looks like you have just put random buttons on a nice background. It definitely needs more work... And look for some Aqua tutorials: crome blobs have nothing to do with bubbles.
Overall rating: 4 (poor). For careless work and disrespect to copyrights.
Hope your next work would be better.
